dc.description.abstractEste trabajo tiene por objeto el estudio de una de las principales muestras del “Derecho penal de la aporofobia” que se pueden encontrar en el Código Penal español: el delito de top manta. La expresión “Derecho penal de la aporofobia” hace referencia a esas normas penales que dispensan un trato discriminatorio a las personas más desfavorecidas económicamente. El top manta, es decir, la venta ambulante de productos falsificados, es el medio de vida de un determinado colectivo de personas en España, el colectivo de inmigrantes pobres, normalmente, en situación administrativa irregular. Sin poder acceder legalmente a un trabajo, esta venta callejera es su manera de subsistir. El legislador entiende que estas conductas deben ser delito por afectar a los derechos de propiedad intelectual e industrial. En este trabajo, sin embargo, se defiende que tal afectación no se produce o no lo hace en un grado tal que merezca la intervención del Derecho penal, que además no se ha mostrado eficaz en la erradicación de estas prácticas. Por eso, se propone su despenalización o, al menos, una interpretación muy restrictiva y favorable a reo del tipo penal.es
dc.description.abstractThis paper aims to study one of the main examples of the “criminal law of aporophobia” that can be found in the Spanish Criminal Code: the offence of illegal street vending. The expression “criminal law of aporophobia” refers to those criminal laws that provide discriminatory treatment to the most economically disadvantaged people. The illegal street vending is the only livelihood of certain individuals in Spain: poor immigrants, usually in an irregular administrative situation. Since they cannot access to the legal labour market, the street vending of counterfeit products is their only way of getting livelihood. The legislator considers that these behaviors shall be a criminal offence because they affects intellectual and industrial property rights. This paper, however, argues that such impact does not occur or does not do so to a degree that justifies the intervention of the criminal law, which has also not been effective in eradicating these practices. For this reason, this paper proposes the decriminalisation of the illegal street vending or, at least, a very restrictive interpretation of the elements of the definition of this criminal offence.en
