Resumen
Este trabajo analiza algunas de las cuestiones fundamentales que se suscitaron con motivo de la anulación de la primera convocatoria de las elecciones al parlamento vasco que habrían de alumbrar la que ha sido la XII Legislatura (2020-2024). Así, este estudio profundiza en cuatro de los problemas de naturaleza jurídico constitucional que se plantearon con motivo de la anulación de la primera convocatoria electoral para las elecciones al Parlamento Vasco que estaban previstas para el 5 de abril de 2020 y que, al igual que en el caso de Galicia, se acabaron anulando. Además de la cuestión jurídica relativa a la anulación de la convocatoria en sí misma, se profundiza en tres cuestiones que el Parlamento Vasco o, mejor dicho, la Mesa, resolvió en falso: las competencias de la Diputación permanente en este anodino período, la celebración de sesiones telemáticas y la delegación del voto de los parlamentarios (antes y después de la celebración de las elecciones).
This paper analyzes some of the fundamental questions that arose due to the cancellation of the first call for the elections to the Basque Parliament that were to illuminate what was the XII Legislature (2020-2024). Thus, this study delves into four of the problems of a constitutional legal nature that arose due to the cancellation of the first electoral call for the elections to the Basque Parliament that were scheduled for April 5, 2020 and that, as in the case of Galicia, they ended up being annulled. In addition to the legal question related to the annulment of the call itself, we delve into three issues that the Basque Parliament or, rather, the Presidium (‘Mesa’), resolved wrongly: the powers of the permanent deputation in this anodyne period, the celebration of telematic sessions and the delegation of the vote of parliamentarians (before and after the elections).
