Resumen
2013 was a particularly relevant year for the study of legal considerations on doping. Not least because of the celebration of the Fourth World Conference on Doping in Sport that focused on the World Anti-Doping Code review process (Code that will be in force on January 1, 2015). This legislative issue has also been of great relevance in Spain. Hence, this work especially considers the legal implications of doping from the Spanish legislation perspective. On the one hand, this country undertook the task of developing and enacting a long-awaited regulation: the Fundamental Law 3/2013, enacted on the 20th of June, for the protection of athletes’ health and the fight against doping in sports activities, which was published on the 21st of June, 2013. On the other hand, on the 30th of April 2013, the Operation Puerto trial’s resolution was made public. This resolution is still generating a storm of controversy with significant differences and approaches from the legal (conducted under the Spanish Criminal Law) and social world. This analysis of the fight against doping will emphasize with the creation of the World Anti-Doping Agency (WADA) and the new World Anti-Doping Code to come into force in 2015.
