dc.description.abstractEste trabajo pretende poner de relieve los enormes méritos que, a juicio del autor, reviste el documento cuya denominación en su original en inglés es la de Prin ciples, Definitions and Model Rules of European Private Law. Draft Common Frame of Re ference (DCFR). Se pondera el gran valor doctrinal del proyecto en cuestión, po niéndose el acento, de manera especial, en la afortunada conjugación de los conceptos y criterios propios del civil law con los del common law. Examinando el contenido y la estructura del documento, con las obligadas limitaciones de espacio, el autor trata de justificar el calificativo del "monumental" que él atribuye al modestamente llamado Borrador.es

Bertan goraipatzen da doktrinaren ikuspuntutik proiektuak duen balioa eta berenberegi azpimarratzen da zein egoki uztartzen diren bertan civil law eta common law; are zehatzago, civil law delakoak berez dituen kontzeptuak eta irizpideak eta common law delakoak dituenak. Agiriaren edukia eta egitura aztertuz gero, kontuan hartuta lan honen luzera mugatua, egilea saiatzen da “erraldoi” izenla gun hori justifikatzen, hain zuzen ere, berak zuhurtasun osoz Zirriborroa deitzen duen hori.eu
dc.description.abstractThis paper is intended to highlight the enormous merits, which in the opinion of the author, which the document whose original name in English is the Principles, Definitions and Model Rules of European Private Law. Draft Common Frame of Reference (DCFR) entails. The considerable doctrinal value of the project shall be considered, with an emphasis given, in particular, to the successful convergence of the concepts and criteria inherent to civil law with those of common law.
