Ley orgánica 4/2015 sobre protección de la seguridad ciudadana: una relectura crítica desde las funciones del derecho

Resumen
Si bien la Ley Orgánica 4/2015 defiende la libertad y seguridad como binomio clave para el buen funcionamiento de una sociedad democrática avanzada. Sin embargo, tras su entrada en vigor el verdadero alcance del Derecho regulativo diseñado al efecto podría ser más cuestionable desde el análisis funcional del Derecho por dos razones. Primero, para entender si el Derecho ha actuado o no como instrumento para alcanzar los fines del Estado y segundo si han quedado o no garantizadas funciones básicas como la seguridad jurídica y la justicia material. A tal propósito, esta propuesta hace una prospección normativa para analizar si en el ámbito de la seguridad ciudadana el Derecho regulativo desempeña una función integradora, irénica o todo lo contrario.
While the Organic Law 4/2015 defends freedom and security as a keystone for the proper function of an advanced democratic society. However, after its entry into force, the true scope of regulatory law provided for this purpose could be more questionable from the functional analysis of the law for two reasons. Firstly, understanding if the law has played or not as an instrument to achieve the goals of the State and secondly if other basic functions such as legal security and material justice have been guaranteed or not. Consequently, this proposal makes a normative approach analysing how in the field of public security regulatory law plays an integral and irenic role or conversely plays the opposite role.
