¿26 años no es nada...?: luces y sombras en la distribución de competencias entre las instituciones comunes de la Comunidad Autónoma del País Vasco y las de sus Territorios Históricos

Resumen
El presente trabajo pretende ofrecer un análisis del funcionamiento del sistema de distribución de competencias entre las Instituciones Comunes de la Comunidad Autónoma Vasca y los Órganos Forales de sus Territorios Históricos, sobre todo, a través del estudio del contenido y aplicación de la denominada «Ley de Territorios Históricos» (LTH), cuando ya se han cumplido más de veinticinco años desde su entrada en vigor. Partiendo de un somero análisis del reparto de competencias en el Estatuto de Gernika, el estudio se detiene en el contenido de la conocida como LTH, precisando el tipo de competencias, los criterios de reparto de las mismas y algunos problemas concretos en la distribución competencial entre dichas Instituciones.
Euskal Autonomia Erkidegoko erakunde erkideen eta lurralde historikoetako foru-organoen artean eskumenak banatzeko sistemaren funtzionamendua aztertzea izan da lan honen xedea. Horretarako, Lurralde Historikoen Legearen edukia eta aplikazioa ikertu ditugu, indarrean sartu zenetik hogeita bost urte baino gehiago bete direnez gero. Hasteko, Gernikako Estatutuan egindako eskumen-banaketaren azterketa laburra egiten dugu, eta ondoren lurralde historikoen legearen edukia sakonago aztertu, hauek guztiak zehaztuz: eskumen-motak, eskumenak banatzeko irizpideak eta aipatu erakundeen artean eskumenak banatzeak dakartzan arazo jakin batzuk.
This present work tries to present an analysis of how the system of allocation of powers among the common institutions from the Basque Autonomous Community and the Historical Territories foral bodies works, above all through the study of the contents and application of the so called «Act for the Historical Territories», taking into account it¿s already been more than twenty five years since its entry into force. Starting from a summary analysis about the allocation of powers by the Statute of Gernika, it stops to study the content of the well known LTH specifying the type of powers, criteria of allocation of them and some concrete problems on the allocation of powers between those institutions.
