Resumen
El Tribunal Supremo ha anulado recientemente una norma municipal que prohibía el acceso y la permanencia en edificios municipales portando el velo islámico integral. Con esta sentencia, nuestro país se suma a un debate europeo, en curso desde hace varios años, sobre la limitación o prohibición del uso de dicho atuendo. De este debate, en este artículo recogemos los argumentos relativos a la igualdad y a la opresión de las mujeres enlazando el razonamiento de los tribunales españoles con el debate doctrinal en curso. El objetivo es cuestionar el uso del argumento sobre la igualdad de género en estos debates, mediante algunos puntos críticos suscitados por la idea de «opresión de las mujeres» elaborada en el ámbito de la teoría feminista.
The Supreme Court has recently overturn a regulation of the municipality of Lleida that prohibited to access and stay in municipal buildings donning Islamic face veils. With this judgement our country has been introduced to an ongoing European debate over the limitation or prohibition of face veils. Of this debate, this article intends to select and gather those arguments regarding sex equality and women’s oppression, and to link the reasoning of the Spanish courts on this issue to the current scientific debate. The aim is to question the use of the argument on sex equality in these debates, assessing some critical issues put forward by the notion of «women’s oppression» as elaborated by feminist theory.
