dc.description.abstractCon la entrada en vigor en el año 2018 del Reglamento 679/2016, de 27 de abril de 2016, General de Protección de Datos (RGPD), se regulaban por vez primera las condiciones para la prestación válida del consentimiento al tratamiento de datos personales concedido por menores de edad. Si bien, el devenir de los años, unido al acelerado e imparable progreso hacia una sociedad digital, ha evidenciado la falta de eficacia de las medidas que impone la normativa. Constituye así tarea reservada del presente trabajo abordar los principales obstáculos que han impedido garantizar la concesión de un consentimiento válido al tratamiento por los más jóvenes. Se ofrece, además, un estudio sobre el Anteproyecto de Ley Orgánica para la protección del menor en entornos digitales aprobado recientemente por el Gobierno español en lo referente a la materia reseñada, así como posibles soluciones en orden a restaurar y asegurar el interés superior del menor internauta.es
dc.description.abstractWith the entry into force in 2018 of General Data Protection Regulation 679/2016 of 27 April 2016 (GDPR), the conditions for the valid provision of consent to the processing of personal data granted by minors were regulated for the first time. However, the passing of the years, together with the rapid and unstoppable progress towards a digital society, has highlighted the lack of effectiveness of the measures imposed by the regulation. It is therefore the task of this paper to address the main obstacles that have prevented the granting of valid consent to processing by young people. It also offers a study of the Draft Bill of the Organic Law for the protection of minors in digital environments recently approved by the Spanish government with regard to the aforementioned matter, as well as possible solutions in order to restore and ensure the best interests of minors on the internet.en
