Resumen
El objetivo de este estudio es analizar, a la luz de la jurisprudencia, dos casos reales que demuestran la importancia de determinar quién es personal de alta dirección por las implicaciones que ello puede tener ante supuestos previstos en la regulación de la relación laboral especial. En el primer caso se analizará la cuestión planteada a partir de la relevancia que puede llegar a alcanzar el preaviso regulado para la relación laboral especial de alta dirección a efectos de determinar si existe dimisión del trabajador o despido improcedente por parte del empresario. En el segundo caso se hará referencia a la fi gura del directivo público profesional para observar cómo determinados empleados públicos pueden quedar excluidos del censo electoral en las elecciones a órganos de representación unitaria, conforme a lo que se prevé en la relación laboral especial de alta dirección, que ha conseguido tener una fuerza centrífuga o extensiva por su aplicación más allá de su estricto ámbito de aplicación, aunque tales empleados, en principio, y, expresamente no tuvieran el carácter de directivo público profesional. Con otras palabras, se parte de la idea de que es indiferente el régimen profesional que resulte de aplicación a tales directivos, pues, aunque se les nombre personal laboral de alta dirección o con carácter administrativo, en todo caso, quedarán excluidos.
The aim of this study is to analyze, in light of jurisprudence, two real-world cases that demonstrate the importance of determining who constitutes high-level mana-gement personnel, due to the implications this may have for situations foreseen in the regulations governing special employment relationships.In the rst case, the issue will be examined from the perspective of the relevance that the notice period regulated for special high-level management employment relationships can acquire in determining whether there has been a resignation by the employee or an unfair dismissal by the employer. In the second case, reference will be made to the gure of the professional public manager to observe how certain public employees may be ex-cluded from the electoral roll in elections for unitary representative bodies, in accordance with the provisions governing special employment relationship for high-level manage-ment, which has managed to have a centrifugal or expansive force due to its application beyond its strict scope, even though such employees, in principle, and expressly, did not have the status of professional public managers. In other words, it is assumed that the professional regime that applies to such managers is irrelevant, since, even if they are designated as high-level management personnel or with an administrative status, in any case, they will be excluded.
