Resumen
Este artículo analiza cómo la Ley 12/2023, de 24 de mayo, por el derecho a la vivienda, ha incorporado deberes y límites específicos al régimen clásico del derecho de propiedad sin alterar sus rasgos esenciales: la unidad, la perpetuidad del dominio, la exclusividad y la abstracción de facultades. Tras un sucinto recorrido histórico que llega hasta la codificación decimonónica del artículo 348 del Código Civil y un contraste con las experiencias francesa, alemana e italiana, se demuestra que la nueva normativa no deroga el «título de la propiedad» sino que concreta su ejercicio en el ámbito residencial. Así, los programas de cesión temporal y movilización de viviendas vacías, el deber de conservación y las inspecciones administrativas configuran un marco que subordina el disfrute del dominio a la función social de la vivienda, reforzando la efectividad del derecho constitucional a un hogar digno, sin fracturar el núcleo teórico ni la titularidad individual del derecho de propiedad, cuestiones, estas, propias del derecho civil.
This article analyses how Law 12/2023 of 24 May on the right to housing, has incorporated specific duties and limits to the classic regime of the right to property without altering its essential features: unity, perpetuity of ownership, exclusivity and abstraction of powers. After a brief historical overview that goes back to the nineteenth-century codification of article 348 of the Civil Code and a contrast with the French, German and Italian experiences, it is shown that the new regulations do not abolishthe ‘title of ownership’ but specify its exercise in the residential sphere. Thus, the programmes of temporary transfer and mobilisation of empty dwellings, the duty of conservation and administrative inspections configure a framework that subordinates the enjoyment of ownership to the social function of housing, reinforcing the effectiveness of the constitutional right to a decent home, without fracturing the theoretical nucleus or the individual ownership of the right to property, all of which are matters of civil law.
