Resumen
Azterlan honen xedea da Balear Uharteetako zuzenbide zibilean gertatutako eraldaketa zehatz bat azaltzea, hain zuzen ere, apirilaren 27ko 3/2009 Legeak oinordeko izateko ezduintasun- eta jaraunsgabetze-arrazoietan eragindakoa. Eraldaketa horrek hur-hurrean izan du 2008. urtean Katalunian gertatutakoa, eta, horregatik, aurrez aurre jartzen dira biak, antzekotasunak eta desberdintasunak nabarmentzeko. Eta bukaeran azaltzen da zein den ezduintasunaren arauketa Euskal Herriko foruzuzenbideetan, Nafarroakoan nahiz Euskal Autonomia Erkidegokoan, etorkizunerako ildoak proposatzearekin batera.
Este estudio se centra en el análisis de la Ley 3/2009, de 27 de abril, de modificación de la Compilación de Derecho Civil de las Illes Balears, sobre causas de indignidad sucesoria y desheredamiento. Dicha reforma legislativa sigue la estela marcada por la producida en el año 2008 en Catalunya, por lo que en este estudio se contraponen ambas, a fin de destacar las similitudes y divergencias existentes entre las mismas. Para concluir, se analiza la regulación de la indignidad sucesoria en los Derechos civiles forales de la Comunidad Foral de Navarra y de la Comunidad Autónoma del País Vasco, y se proponen líneas de mejora y reforma en dichas regulaciones para el futuro.
This article focuses on the analysis of Act 3/2009, of 27 April, amending the Collection of Civil Law of the Balearic Islands, concerning the grounds of unworthiness to inherit and disinheritance. The legislative amendment follows in the distinct wake of that which took place in 2008 in Catalonia, which is why, this investigation is compared against both, so as to highlight the similarities and differences betwen same. In conclusion, the regulation on the grounds of unworthiess to inherit under provincial civil law of the Autonomous Community of Navarre and the Basque Autonomous Community is analysed, and areas for improvement and an amendment of those regulations in the future are proposed.
