Resumen
Esta sección monográfica aborda cómo la emergencia climática está dejando de ser un mero contexto para convertirse en un vector normativo que reconfigura categorías del constitucionalismo: obligaciones positivas, legitimación procesal, reglas probatorias, control judicial y reparto competencial en sistemas multinivel. Los trabajos destacan el papel creciente de la jurisdicción nacional e internacional frente a la insuficiencia de la acción pública, con referencia a la jurisprudencia reciente nacional, supranacional e internacional. Los trabajos aquí incluidos reúnen enfoques desde distintas disciplinas jurídicas para analizar el tránsito hacia una protección ambiental global cualificada compatible con los principios de las democracias constitucionales.
This special issue examines how the climate emergency is ceasing to be a mere backdrop and is becoming a normative driver reshaping core categories of constitutionalism: positive obligations, standing, evidentiary rules, judicial review, and the allocationof powers in multilevel systems. The contributions highlight the growing role of domestic and international adjudication in response to inadequate public action, with reference to recent national, supranational, and international case law. Bringing together approaches from different legal disciplines, the articles collected here analyse the shift towards a qualified, global form of environmental protection compatible with the principles of constitutional democracies.
