dc.description.abstractEste artículo presenta una selección de ejemplos recientes de litigación transnacional contra empresas europeas e inglesas por violaciones de derechos humanos. En el Reino Unido, tras una década marcada por condenas a multinacionales por los hechos acaecidos en terceros estados, observamos la resurrección del forum non conveniens bendecida por el Brexit. Mientras tanto en la Unión Europea, tras unos primeros intentos sonados y fallidos, buscamos una solución regulatoria de difícil encaje en la práctica y que pasa por alto el Derecho Internacional Privado. Este estudio se centra en los casos Vedanta, Begum, Dyson y Kik. Todos ellos, casos en los que se ha constatado graves violaciones de derechos humanos y que, en el peor de todos, el colapso del Rana Plaza, se han cobrado un millar de vidas sin que la Europa de la ESG, la Responsabilidad Corporativa y la Ética Empresarial haya sido capaz de dar una respuesta a la altura.es
dc.description.abstractThis article presents a selection of recent examples of transnational litigation against European and British companies for human rights violations. In the United Kingdom, after a decade marked by convictions of multinationals for acts occurring in third states, we observe the resurrection of the Brexit-blessed forum non conviniens. Meanwhile, in the European Union, after some first resounding and unsuccessful attempts, we are looking for a regulatory solution that is difficult to fit in practice and which ignores Private International Law. This study focuses on the Vedanta, Begum, Dyson and Kik cases. All of them, cases in which serious human rights violations have been found and which in the worst case, Rana Plaza, have claimed more than thousand lives, whereas a European Union driven by ESG, Corporate Responsibility and Business Ethics being unable to provide a response to this drama.en
