Resumen
El artículo examina algunos de los instrumentos jurídicos internacionales y europeos relativos a la prohibición de la discriminación racial. La hipótesis central parte de la afirmación de que el actual marco jurídico sobre la discriminación racial se asienta sobre unas bases que aún podrían ser utilizadas y desarrolladas en mayor medida, especialmente desde el punto de vista de la evolución de ciertos estándares jurisprudenciales. La aportación, por tanto, consiste en que el análisis permita fortalecer los pilares del principio antidiscriminatorio y hacer posible que la normativa internacional y europea vigente sea empleada de una manera más significativa y coherente. Desde una visión de conjunto, se comparan los principales instrumentos reguladores de este tipo de discriminación, lo que facilita valorar su alcance general y particular. Como conclusión, se propone que en todo análisis sobre situaciones de desigualdad racial se integren los estándares jurisprudenciales contemporáneos más avanzados.
This article analyses the international and European legal framework regarding the prohibition of racial discrimination. The main hypothesis assumes that the contemporary legal regime on racial discrimination is settled on some basis which could still be used and developed to a greater extent, specially from the point of view of the evolution of certain jurisprudential standards. The contribution is thus an analysis which would facilitate the strengthening of the pillars of the antidiscriminatory principle and make it posible for the international and European legislation currently in place to be used in a more significant and coherent way. From an overall wiew of the prohibition of racial discrimination, the article compares the main legal instruments related to this kind of discrimination. This focus allows us to interpret the content and scope of the antidiscriminatory principle. To conclude, the article proposes to integrate the most progressive judicial standards in any analysis related to a situation of inequity.
