La evolución social, la mejora de las condiciones sanitarias, y especialmente el desarrollo de la Medicina, han permitido tornar lo que históricamente venía siendo ordinario en algo absolutamente inusual. A pesar de ello, el legislador español parece observar la situación desde la lejanía, no tomando conciencia del cambio de situación. Esta pasividad se observa en que el tratamiento legal que actualmente reciben los nacidos muertos poco difiere del que se daba en el siglo XIX, cuando se redactó el Código Civil. Esto se traduce en que aquellas familias que pasan por este duro trance, deben soportar la frialdad de las instituciones jurídicas existentes en el Derecho español que, en la búsqueda de una seguridad jurídica a ultranza, olvida el principal pilar de todo ordenamiento jurídica: la persona.Prenatal death has become an extraordinary misfortune. Social evolution, the improvement of sanitary conditions, and especially the development of Medicine, have turned what had historically been ordinary, into something absolutely unusual. Despite this, the Spanish legislator seems to be observing the situation from afar, not being aware of the change in situation. This passivity is observed in that the legal treatment received by stillborns differs little from that of the 19th century, when the Civil Code was drafted.
